This Data Policy explains how AutoPipeline365 LLC (“AutoPipeline365,” “Company,” “we,” “us,” or “our”) processes, stores, accesses, and manages data within the AutoPipeline365 platform (the “Service”).
This Data Policy supplements our Terms and Conditions and Privacy Policy and applies to all users, customers, sub-accounts, and authorized users of the Service.
By using the Service, you acknowledge and agree to this Data Policy.
1. Scope of This Data Policy
This policy applies to:
Customer data
End-user data
Leads, contacts, and communications
Messaging content (SMS, MMS, email)
Automation workflows
Usage metadata
Billing and account records
AutoPipeline365 acts as a technology service provider and data processor, not a data controller for customer-submitted data.
2. Data Ownership
Customers retain ownership of all data they upload, import, or generate using the Service (“Customer Data”)
AutoPipeline365 does not claim ownership of Customer Data
By using the Service, you grant AutoPipeline365 a limited, non-exclusive, worldwide license to process Customer Data solely to operate and improve the Service.
3. Data Processing & Use
AutoPipeline365 processes data for the following purposes:
Providing CRM, automation, messaging, and analytics features
Transmitting communications through integrated providers
Account management and billing
System monitoring, debugging, and performance optimization
Security, fraud prevention, and abuse detection
Legal compliance and enforcement of agreements
We do not validate the legality, accuracy, or compliance of Customer Data.
4. Customer Responsibility for Data Compliance
You acknowledge and agree that you are solely responsible for:
Lawful collection of data
Obtaining proper consent (SMS, email, marketing)
Compliance with TCPA, CAN-SPAM, GDPR, CCPA, CPRA, and other regulations
Accuracy and legality of Customer Data
Managing opt-in, opt-out, and suppression lists
AutoPipeline365 is not liable for regulatory fines, penalties, claims, or enforcement actions arising from your data usage.
5. Messaging & Communication Data
If you use SMS, MMS, email, or messaging features:
Message content is transmitted via third-party providers
Delivery is subject to carrier rules, filtering, throttling, and blocking
Fees may apply based on usage
AutoPipeline365:
Does not guarantee message delivery
Does not monitor message legality
Is not responsible for carrier decisions or enforcement
6. Data Sharing & Sub-Processing
Customer Data may be shared with:
Infrastructure providers (hosting, storage, security)
Messaging and email service providers
Payment processors
Analytics and monitoring tools
Authorized internal personnel
All sub-processors are used solely to operate the Service.
We do not sell Customer Data.
7. White-Label & Sub-Accounts
For white-label or SaaS configurations:
The primary account holder is responsible for all sub-accounts
Sub-account data is processed under the primary account’s authority
AutoPipeline365 bears no responsibility for agreements between customers and their end users
8. Data Security Measures
We implement reasonable administrative, technical, and organizational safeguards, including:
Access controls
Encrypted transmissions where applicable
Monitoring and logging
Vendor risk management
However, no system is fully secure, and use of the Service is at your own risk.
9. Data Retention
Data is retained as long as necessary to provide the Service
Upon account termination, data may be deleted without notice
Backup copies may persist temporarily for operational or legal reasons
AutoPipeline365 is not responsible for customer data retention obligations.
10. Data Deletion & Export
Customers are responsible for exporting their data before termination
Data deletion requests may be honored subject to technical and legal limitations
We do not guarantee recovery of deleted data
11. International Data Transfers
Customer Data may be processed and stored in the United States or other jurisdictions where our providers operate.
By using the Service, you consent to these transfers.
12. No Fiduciary Duty
AutoPipeline365 does not act as a fiduciary, legal advisor, compliance advisor, or data controller for Customer Data.
13. Limitation of Liability
To the maximum extent permitted by law:
AutoPipeline365 is not liable for data loss, misuse, or unauthorized access
Liability related to data handling is limited as stated in our Terms and Conditions
14. Updates to This Data Policy
We may update this Data Policy at any time. Continued use of the Service constitutes acceptance of changes.
